1) Agreement to Terms

By accessing zbcessentials.com (the “Website”) or purchasing from ZBC Essentials (“ZBC,” “we,” “us,” “our”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Website or our Services. We may update these Terms at any time by posting a revised version. Your continued use constitutes acceptance.

2) Eligibility

You must be at least the age of majority in your state to use the Website and place orders. You represent that you have capacity to enter a binding contract.

3) Accounts, Registration & Security

You may create an account by providing accurate, current information. You’re responsible for maintaining the confidentiality of your login and for all activity under your account. Notify us immediately of any unauthorized use.

4) Communications (Email & SMS)

By creating an account or purchasing, you consent to receive transactional emails (order confirmations, shipping updates) and, if you opt in, marketing emails/SMS.

Email opt-out: Use the unsubscribe link in any marketing email.

SMS opt-out: Reply STOP to end, HELP for help. Message/data rates may apply; frequency varies. Carrier is not liable for delayed/undelivered messages.

5) Product Information, Pricing & Availability

We strive for accuracy but do not warrant that product descriptions, images, pricing, or availability are error-free. We may correct errors and change information or prices at any time without notice. Items may vary slightly in color/texture due to small-batch production.

6) Offers & Discounts

Discount codes must be entered at checkout and cannot be combined unless explicitly stated. We may limit promotions to certain items, dates, or quantities and may refuse orders that misuse promotions.

7) Orders, Billing & Address Accuracy

We may limit or cancel quantities per person/household/order at our discretion. Provide complete, accurate billing, shipping, and contact information and promptly update it as needed. Orders returned due to incorrect/incomplete addresses will require additional shipping fees to reship.

8) Shipping; Risk of Loss; Lost/ Stolen Packages

Shipping, handling, and taxes are shown at checkout. Title and risk of loss pass to you upon carrier acceptance. Once a package is marked delivered by the carrier, ZBC is not responsible for loss or theft. 9) Use of Website

You agree not to: (a) violate laws; (b) infringe IP or privacy rights; (c) upload malware; (d) scrape or harvest data; (e) attempt to breach security; (f) abuse, harass, or post unlawful/obscene content; or (g) engage in spam or automated access. We may suspend or terminate access for violations.

10) Limited License

We grant a limited, non-exclusive, non-transferable license to access and use the Website for personal, non-commercial purposes. No copying, distribution, modification, derivative works, or exploitation without our prior written consent.

11) Payments

We accept major payment methods (e.g., credit/debit cards and available digital wallets). By submitting payment, you represent you’re authorized to use the method and authorize us or our processor to charge the full order amount (including taxes, shipping, and any applicable adjustments).

12) Reviews, Feedback & Submissions

If you post reviews or send feedback, you grant ZBC a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and display such content for any lawful purpose. We may remove content that we deem inappropriate or misleading.

13) Intellectual Property

All Website content—including names, logos, text, graphics, images, product designs, and code—is owned by or licensed to ZBC and protected by IP laws. Unauthorized use is prohibited.

14) Privacy & Cookies

Your use of the Website is subject to our Privacy Policy, which explains how we collect, use, and safeguard personal information. The site may use cookies and similar technologies; you can adjust browser settings, but some features may not function.

15) Warranty Disclaimer

THE WEBSITE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ZBC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Handmade variation is normal.

16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZBC AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOST DATA; BUSINESS INTERRUPTION; OR PROCUREMENT OF SUBSTITUTE GOODS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE.

17) Indemnification

You agree to defend, indemnify, and hold harmless ZBC from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, misuse of the Website, or violation of law or third-party rights.

18) Dispute Resolution & Arbitration (U.S.)

Informal Resolution. Contact us first at care@zbcessentials.com; we’ll try to resolve disputes informally.

Binding Arbitration. If unresolved, any dispute arising from these Terms or your use of the Website/Products will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You and ZBC waive jury trial and class actions. The arbitrator may award individual relief permitted by law. Venue shall be your county of residence or Essex County, New Jersey unless both parties agree otherwise.

Small Claims. Either party may bring an individual action in small-claims court.

This section survives termination.

19) Termination

We may suspend or terminate access for any violation of these Terms or as required by law. Your obligations that by nature should survive (e.g., IP, indemnity, limitations of liability, dispute resolution) will survive termination.

20) Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control (e.g., natural disasters, acts of government, labor disputes, interruptions of internet/services, or carrier delays).

21) Severability; Waiver

If any provision is unlawful or unenforceable, it will be limited or severed to the minimum extent necessary, and the remainder remains in effect. Our failure to enforce any right is not a waiver.

22) Entire Agreement

These Terms, plus our Privacy Policy and Shipping & Returns Policy, are the entire agreement between you and ZBC regarding the Website and Services, superseding prior agreements.

23) All Sales Final / Returns

Due to the personal, handmade nature of our products, all sales are final. Please see our Shipping & Returns Policy for damage claims and timelines.
